By accessing or using Poketmart ("the Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform. We reserve the right to update these Terms at any time with notice.

2. Eligibility

You must be at least 18 years old to create an account or make purchases on Poketmart. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding agreements.

3. Account Registration

When you create an account, you agree to:

• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account

4. Buyer Terms

As a buyer on Poketmart, you agree that:

• All purchases are subject to the seller's license terms
• Digital products are non-transferable unless the license explicitly allows it
• Refunds are subject to our Refund Policy
• You will not share, redistribute, or resell purchased products without authorization
• Download links are for personal use only

5. Seller Terms

As a seller on Poketmart, you agree that:

• You own all rights to the content you list, or have permission to sell it
• Your products comply with all applicable laws and our content policies
• Poketmart retains a platform commission (currently 20%) from each sale
• You are responsible for paying applicable taxes on your earnings
• You will respond to customer complaints in a timely and professional manner
• Fraudulent or deceptive listings will result in immediate account suspension

6. Prohibited Content

The following content is strictly prohibited on Poketmart:

• Content that violates any law or regulation
• Malware, spyware, viruses, or other harmful code
• Pirated software, music, films, or other copyrighted material
• Content that infringes intellectual property rights
• Adult or sexually explicit content
• Content that promotes violence, hate, or discrimination

7. Intellectual Property

Poketmart and its content, including logos, trademarks, and platform software, are owned by or licensed to Poketmart. Sellers retain ownership of their products. Buyers receive a license to use purchased products as described in the product's license terms.

8. Limitation of Liability

To the maximum extent permitted by law, Poketmart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of your use of the Platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may close your account at any time by contacting us.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration, except for claims that may be brought in small claims court.
